Terms of Use for Tennis Notebook

1. Acceptance of Terms

Tennis Notebook is a tennis journal app for iPhone and Android, made by Pixelbrew Studio LLC (“Tennis Notebook”, “we”, “us”). By accessing or using the Tennis Notebook app, you agree to be bound by these Terms of Use (“Terms”). If you disagree with any part of the terms, you may not access the service.

2. User Responsibilities

  • Age Restriction: Users must be at least 13 years old to access and use the Tennis Notebook app. Any use of the app by individuals under 13 is strictly prohibited and done at their own risk. Tennis Notebook disclaims all liability for such unauthorized use.
  • Your Account: You need an account to use the app. You sign in with your email address and a one-time code we send to it, so your notebook is kept under that email. Use an email address that is yours and that you can still open.

3. Intellectual Property

All data and content created by users remain the property of the user. However, Tennis Notebook reserves the right to access user data for administrative or emergency purposes.

The app itself, including its design, text, graphics and code, belongs to Pixelbrew Studio LLC. A subscription or purchase lets you use the app. It does not give you ownership of it.

4. Privacy Policy

User data and privacy are protected. How we collect and use information is described in our Privacy Policy. An account deletion system is in place to ensure complete erasure of user data upon request: you can delete your account at any time from Settings in the app.

5. Subscriptions and Payments

  • Access: Tennis Notebook is free to download. Using it requires a free trial, an active subscription or the lifetime purchase.
  • Plans: We offer subscriptions that renew automatically, for periods such as a week, a month or a year, and a one-time lifetime purchase. The plans on offer and their prices are shown in the app before you buy. Prices differ by country and currency, can change over time, and can include promotional offers.
  • Free Trials: Some subscriptions start with a free trial for new subscribers. The app shows how long the trial lasts before you start it. Unless you cancel at least 24 hours before the trial ends, it becomes a paid subscription and you are charged the price shown.
  • Billing: Payment is charged to your Apple App Store or Google Play account when you confirm the purchase. We do not see or store your payment card details.
  • Renewals: Subscriptions automatically renew for the same period unless canceled at least 24 hours before the end of the current period. If the price of your plan changes, the store tells you in advance.
  • Canceling: You can cancel at any time in your App Store or Google Play account settings. You keep access until the end of the period you have paid for. Deleting the app or your account does not cancel a subscription.
  • Lifetime Purchase: The lifetime plan is a single payment and never renews. It gives you access to Tennis Notebook for as long as the app is available.
  • Restoring Purchases: After reinstalling the app or changing phones, use Restore in the app to bring back a purchase.
  • Refunds: Purchases are processed by Apple and Google, and refunds are handled by them under their own policies. To ask for a refund, contact the store you bought from.

6. Usage Guidelines

  • App Features: Users are encouraged to follow guidelines provided in the app for optimal use of features.
  • Limitations: Failure to adhere to guidelines may affect the app’s performance, for which Tennis Notebook is not liable.
  • Your Notebook: Tennis Notebook is a journal for your own tennis. You are responsible for what you enter in it, including notes about other players.

7. Termination

Tennis Notebook reserves the right to terminate or suspend access immediately, without prior notice, for reasons including but not limited to breaches of these Terms, such as hacking or attempts to access unauthorized data.

You can stop using the app and delete your account at any time. If you have a subscription, cancel it in your store account settings first, as described in section 5.

8. Amendments to Terms

Tennis Notebook may revise these Terms from time to time. The most current version will always be posted on our website, with the date it was last updated at the top.

9. Governing Law

These Terms shall be governed in accordance with the laws of United States and the state of Texas, without regard to its conflict of law provisions.
